Any estate planning that a lawyer can do for a married couple can also be done for an unmarried couple. However, domestic partner estate planning also involves other aspects not covered in traditional estate plans. Non-married couples need to be more proactive because if you do not have a plan, the law does not provide your partner with the same protections given to married couples.
For example, if you are married, there are automatic protections for your spouse and children. This is not the case for a long-time partner. All end-of-life decisions are given to the family and blood-relatives, not the partner, unless you are proactive in drafting an advance health care directive, living will, and other important estate planning documents:
